Exciting Updates for TSS 482 Visa Holders

Starting from November 25, 2023, significant changes will enhance the pathways to permanent residency for Temporary Skill Shortage (TSS) 482 visa holders. The Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS) 186 will be amended, making it easier for TSS visa holders to transition to permanent residency.

Eligibility Criteria for ENS 186 Visas

  1. Employment Continuity: TSS 482 visa holders must continue working in their nominated occupation.
  2. Reduced Sponsorship Period: Sponsored visa holders will now be eligible for ENS 186 TRT after two years of sponsorship by their employer, reduced from the previous three-year requirement.
  3. Nomination and Visa Requirements: Applicants must meet all other nomination and visa requirements for the ENS 186 TRT stream.
  4. Onshore Applications: The limit on onshore applications for Short-Term stream 482 TSS visas has been removed.

Pathway to Permanent Residency through ENS 186

TSS 482 visa holders can transition to permanent residency if:

  • Their occupation is on the Medium-Term list.
  • They have worked for the same employer for two years on their TSS 482 visa.
  • They have at least competent English (IELTS 6 in each band or equivalent, with exemptions available).
  • They are under 45 years old at the time of applying for permanent residency.

Regional Pathway for TSS 482 Visa Holders

TSS 482 visa holders working in designated regional areas also have a pathway to permanent residency if:

  • Their occupation is on the Regional Occupation list.
  • They have worked for the same employer and in the same occupation for three years on their TSS 482 visa.
  • They meet the English proficiency requirements.
  • They are under 45 years old at the time of applying for permanent residency.

Alternative Pathways to Permanent Residency

If you do not meet the above criteria, other options include:

  • Employer Sponsored Direct Entry Stream (ENS/RSMS)
  • General Skilled Migration (189/190/489)
  • Partner Migration (for partners/spouses of Australian permanent residents or citizens)
  • Visa Options After 45

Medium-Term TSS 482 Visa: Key Features

The Medium-Term TSS 482 visa is granted for four years, allows for multiple onshore renewals, and provides a pathway to permanent residency after three years. This visa is targeted at skilled occupations critical to Australia’s needs.

2024 Changes: New Migration Strategy

In 2024, Australia will introduce a new three-tiered visa system to replace the TSS 482 visa:

  1. Specialist Skills Visa Pathway: No occupational list, 7-day processing, for those earning over $135,000 per year. Excludes trades, machinery operators, drivers, and labourers.
  2. Core Skills Visas Pathway: Focuses on trades workers, with a revised ‘skills in demand list’ and earnings between $70,000 and $135,000.
  3. Essential Skills Visa Pathway: Targeted at specific sectors, such as aged care and disability, for those earning under $70,000. This visa involves union oversight and is capped.

  • Four-Year Visas: Visas will be granted for up to four years.
  • Flexibility: Visa holders can change employers more easily.
  • Pathways to Permanent Residency: Clear pathways to permanent residency.
  • Annual Indexing: The Temporary Skilled Migration Income Threshold (TSMIT) will be indexed annually.
  • Employer Sponsor Register: A public register of employer sponsors will facilitate ease of movement between employers.
