Who is AAT?

The Administrative Appeals Tribunal (AAT) is an independent body that reviews decisions made by the Australian Federal Government. Since 1 July 2015, the functions of the Migration Review Tribunal (MRT) and Refugee Review Tribunal (RRT) have been consolidated into the Migration Division of AAT. It is the only authority that can review the merits of visa application decisions.

What Does AAT Do?

The AAT thoroughly reviews your case and makes a fresh decision based on:

  • The facts you provided.
  • The relevant laws.
  • Evidence, forms, and documents submitted to the Department of Home Affairs.

Important: There Is a Time Limit!

When appealing a decision, you must lodge your application for review within the timeframe specified in your decision notification letter. Additionally, an application fee may apply for lodging an appeal. It’s crucial to act quickly to avoid missing your chance for review.

What Is the Processing Time?

The time it takes for an appeal to be processed varies depending on the case, but it typically takes 12 to 18 months. For exceptional cases, you may request priority processing, although approval is not guaranteed.

What Are the Possible Outcomes?

  • Affirm: The AAT agrees with the Department of Home Affairs’ decision. The visa refusal or cancellation stands unchanged.
  • Vary: The AAT disagrees with the Department’s decision. Your application is returned to the Department of Immigration with new instructions or recommendations for further assessment.

What If Your Appeal Fails?

If the AAT outcome is "Affirm", you have two further options:

  • Application to Federal Court: This is available only in cases where there is a legal error in the AAT’s decision.
  • Application for Ministerial Intervention: You can request the Minister for Immigration to intervene, providing compelling reasons. Ministerial interventions are rare but may result in a positive outcome.
